1. Acceptance of These Terms
By booking, purchasing, opting in to SMS updates, or otherwise using any cleaning or maintenance service (“Service”) offered by Air Duct Cleaning of South Florida (“ADC-SF,” “we,” “our,” or “the Company”), you (“Customer”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not schedule or use the Service.
2. Service Description & Scope
ADC-SF provides professional air-duct, dryer-vent, and HVAC system cleaning, sanitizing, and related maintenance. Unless expressly stated in writing, our Services do not include repair or replacement of HVAC components, asbestos abatement, licensed mold remediation, or structural carpentry.
3. Estimates, Pricing & Taxes
- Estimates are free and valid for 30 days unless otherwise stated.
- Final pricing may change if on-site inspection reveals conditions not disclosed at the time of the estimate (e.g., additional vents, severe contamination, restricted access).
- Prices exclude applicable sales tax or government fees, which will be added to the final invoice where required.
4. Scheduling, Access & Preparation
- Appointments are available Monday–Saturday, 7 a.m.–8 p.m., with 24-hour emergency response upon request.
- The Customer must ensure clear access to the HVAC equipment, vents, and return registers. Fragile or valuable items should be removed from the work area.
- Pets must be secured away from work zones for the duration of the Service.
- ADC-SF reserves the right to reschedule if unsafe conditions or severe weather prevent safe operation of equipment.
5. Customer Responsibilities
- Provide accurate information about the HVAC system, past maintenance, and known hazards (e.g., asbestos, lead paint).
- Ensure electricity, water (if required), and parking are available for our technicians.
- Set the thermostat to “OFF” before work begins and keep it off until the job is complete.
6. Payment Terms
- Payment is due in full upon completion of the Service unless otherwise agreed in writing.
- We accept major credit cards, debit cards, checks, and ACH transfers. Returned checks are subject to a $35 fee.
- Late balances accrue interest at 1.5 % per month (18 % APR) or the maximum rate allowed by Florida law, whichever is lower.
7. Cancellation & Rescheduling
- No fee for cancellations or rescheduling made at least 24 hours before the appointment.
- Cancellations within 24 hours or Customer no-shows may incur a $75 trip charge.
8. Satisfaction Guarantee & Limited Warranty
If you are not fully satisfied, notify us within 7 days and we will return once at no cost to address the issue. Our workmanship is warranted for 30 days from the service date. This warranty excludes damage or contamination caused by subsequent construction, water intrusion, occupant negligence, or normal dust accumulation after the Service.
9. Limitations of Liability
ADC-SF’s total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid for the Service giving rise to the claim. We are not liable for indirect, special, incidental, or consequential damages (including loss of use or profits). Indoor air-quality improvements vary by property; we do not guarantee specific health outcomes.
10. Indemnification
The Customer agrees to indemnify and hold harmless ADC-SF, its employees, and subcontractors from any third-party claims, damages, or expenses arising out of Customer negligence, breach of these Terms, or failure to disclose hazardous conditions.
11. Force Majeure
Neither party shall be liable for delays or failure to perform due to events beyond reasonable control, including natural disasters, acts of God, strikes, epidemics, or government actions.
12. Intellectual Property
All content on the Website—including text, graphics, logos, and photos—remains the property of ADC-SF or its licensors. Reproduction or distribution without prior written consent is prohibited.
13. Privacy
Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute shall be resolved in the state or federal courts located in Miami-Dade County, Florida. The parties waive any objection to venue or personal jurisdiction.
15. Changes to These Terms
We may update these Terms periodically. Revised versions will be posted on the Website with a new “Last Updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
